As you can see I'm unable to level my skills past 2. I have the same issue with skills at level 1 as well. What am I missing?

To level an ability from 2 to 3, you need 3 ability points. To level it up from 3 to 4, you need four ability points. If you want to have more points, you need to save up points from a previous level up. The higher level you become, the more ability points you will gain at level up.

and from the image it appears he has 4 to spend, and can't spend in 2 trees that are only at 2 (should be able to spend 3pts in both)

No, the picture shows he has 2 in 2 trees, which adds up to 4. The 4 beside Skills totals the category points (including temp ones/ones from gear).

Chances are it was just a simple "he only had 1 or 2 points available to spend.
