I literally just walked out of the local Fry's Electronics in my town. I looked everywhere for this game and finally found one copy there. No sooner did I get home and got it installed, when I went to this site for fan info (because this game is so good). Now I realize my version is old and has been superseded by the remastered version. Naturally, Fry's will not accept returns on software. I am so angry I literally almost snapped the install DVD in half. So my title should be self-explanatory, I am trying to salvage my purchase by finding some kind of upgrade deal so it's not a total loss. Seriously, these old versions shouldn't be on the shelves of a major US retailer, years after release, if a newer version is available.

Unfortunately, there was no DVD release of DKS in the US (or UK). Even in Canada where there was a release, it is mostly just available from Amazon or Gamestop (Best Buy, etc, only have listings for the original D2:ED), or at least that was the case the last time I checked.

If you get the (digital download) add-on Flames of Vengeance, there is a patch to convert D2:ED+FoV to DKS. That would be a bit more of a hassle than getting DKS, though, and could be more expensive depending on the price you paid for D2:ED.

There is no general trade-in or upgrade program (that would require different publishers, retailers and distributors working together). Steam offered DKS at a discount to people who bough D2:ED through them, but that's about it.
Some retailers buy used games and resell them, but I don't think you'd get most of your money back that way. You could try selling it on eBay, or something.

It is not that uncommon to have different versions of a game available. When I bought the diamond edition of Neverwinter Nights there were lots of copies of the gold and original releases available (sometimes at a higher price), as well as the separate add-ons.
I once saw boxes of an MMO game on store shelves after the servers had been shut down. I don't think retailers make much effort to keep up with individual games, and doubt distributors or publishers make any effort to recall 'outdated' products (at least in certain cases some people may prefer the original products to the update).

If this is true in the US, it will probably be the route I'll try. Thanks for the info. It's not so much that games have multiple versions...I know devs have to get all the profit they can out of their existing work. What annoys me is that retailers are still selling the old version for $20+ to suckers like me. Coupled with a no-returns policy on software for a double whammy. I love how supposed anti-piracy measures like zero-return software polices and the utterly vile SecureROM only harm legitimate consumers.

Edit: I found the patch mentioned by Raze. Gonna try and find an inexpensive FOV.

I know your pain.

Getting DAO + X-pack here in the shop costs one 3x as much as shipping the Ultimate Collector's Edition from England (they don't sell them here at all). And then you're also missing out on all the DLC obviously.
I think enough people don't know about the UCE and get suckered into that. Poor folks.
