after finding the smelly scarf (after defeating Evelyn) the dog's dialogue doesn't allow for him to smell it. What's the deal with this scarf? Why is it there?

There are several smelly items hidden through Cyseal's town.
The idea is that you can give these to a dog in order for him to smell out Jake's murderer.

Since you already terminated Evelyn with extreme prejudice, there's no need for these smelly items anymore.

I have already collected these items prior to defeating her (boot, coat, socks) and in each case the dog's dialogue allowed for that. But in the case of the scarf I don't see how else I could have gotten it prior to defeating her. Did she happen to have it on her before? Would I have had to resort to pickpocketing?? and most importantly, did I miss some XPs ?

You probably had to pickpocket it off of her. Anyway, no worries, I doubt you missed much.

Each suspect has both a smelly item you can pickpocket* and a smelly item you can steal from their home or workplace. You only need one for each suspect, and the whole "talk to the dog" is only one option for narrowing down the list.

In Evelyn's case, if you already had the dog smell her coat, you don't need to have him smell the scarf.

*You can also kill them to get this item, as you demonstrated, but except for Evelyn that approach will cause you other problems.
