I am unsure whether it's a bug, or a "homebrew" quirk, however I do not think wizards should be able to learn the spells outside of their class spell list.

As far as I remember - been a while since I did run a PnP game - the forms of magic (arcane, divine, mental) are no longer as clearly seperated in 5e.

I think it is a bug, you should only be able to learn spells in your spell list.

You can also learn cantrips or warlock spells witch is also a bug, so it could be that they did not implemented the restriction yet.

But hey .. if its a homebrew divine soul wizard for the win and we no longer need shadowheart in the group.

True, however considering RAW you are still limited to the wizard spell list. From the wizard class section (SRD under your spellbook https://www.dndbeyond.com/classes/wizard)

"Copying a Spell into the Book. When you find a wizard spell of 1st level or higher, you can add it to your spellbook if it is of a spell level you can prepare and if you can spare the time to decipher and copy it.
Copying that spell into your spellbook involves reproducing the basic form of the spell, then deciphering the unique system of notation used by the wizard who wrote it. You must practice the spell until you understand the sounds or gestures required, then transcribe it into your spellbook using your own notation."

Moreover as per RAW you cannot use the scrolls outside of your caster class:
"A spell scroll bears the words of a single spell, written in a mystical cipher. If the spell is on your class’s spell list, you can read the scroll and cast its spell without providing any material components." (DMG page 200, SRD link https://www.dndbeyond.com/magic-items/spell-scroll).

Personally I do not think that being able to cast any scroll in the game is game breaking (especially considering the revivify scrolls we get), it only sliiightly hurts the Thief subclass of Rogue (at level 13, which probably won't even be in the game), however wizards being able to learn any spell in the game by scribing the scrolls is frankly speaking, a little bit insane.

OMG please do not remove this, I've always wanted to learn divine magic and was gutted the Archivist background was deleted

Class dilution is a real issue for adaptations of D&D. A lot of modern CRPGs are trying to move away from class systems, because clearly there's a market for that kind of gameplay, and I love playing new RPG systems and exploring the different rulesets they bring to bear.

But creating characters in D&D is all about the things that make your class unique, and this is a D&D game. So please - please - please - let this game be for those of us who enjoy constraints (like the clear separation of arcane and divine magic) for the meaningful differences they can produce in a character.
