i can only speak of the game with the latest patch (1.0034A), as this is how i played it. i had minimal, if any, problems. there are a couple of non-functioning skills, including true shot for bow, but only a couple and those are quite a minor issue.
i believe most of what you've read (and were speaking of) was in regards to the original release (pre-patching).
as far as the game is concerned, i will tell you you're in for a treat. you'll hear this from more than just myself - divine divinity is everything diablo II wishes it had been.
this comes with one small caveat. since you state you've played diablo II for 2 years now, i assume you've been playing it multi-player. please understand, divine divinity is a single-player only game.
if you're after one of the sweetest single-player gaming experiences you can find, do yourself the favor of purchasing it. then head over to the help/tips/tricks section of this forum and read about starting a character. there is a TON of great information there without being forced to read spoilers.
additionally, there are people here (the forum) who are quite knowledgable regarding the game, and are more than willing to be of assistance should you need any.
