Ok.
I talked to Rob about joining the thieves guild, and he told me to rob the guy in the seat. I went over and failed, and was arrested and thrown in jail. So, i lvl up a bit and come back wit a better pickpocket skill. I then proceed to pickpocket the guy in the chair, only to find that the necklace i need is gone! It seems that when i was arrested the town gaurd confiscated it, and i sorta need it. Any help?

When I got put in jail I found a key in the bed to get out. There was a chest in the next room with all my inventory and I was caught by the guards when I was retrieving it. I fought and killed them all and didn't seem to suffer any serious loss of reputation or other repercussions. You may be able to go back to the jail in the SE corner of the town watch building and retrieve the necklace.

Sweeny, the drunk with the necklace, should be standing, IIRC. In any case, you should only need level 1 of Pickpocket to steal from him. Try looking around the tavern again.
It is usually a good idea to save before trying to steal.
