I think you are right about that, and doubt he is in DD, especially since this is the only topic in the DD forum that mentions 'Cain'. However, I don't think a reference to a copyrighted character would violate that copyright. AFAIK they would have to use him in a major or defamatory way to run into legal problems. There are lots of references to other characters, games and books in both DD and BD.

Deckard Cain was a Zandalor type character in Diablo II, who identified items and gave out quest and plot information.
