I installed the game just fine, but it won't read my disk at the startup (its a bit scratched) but it installed just fine, is there any CD crack or methods that I could do to make it read? thanks.

The 1.49 patch removes the StarForce copy protection (and thus the need for the disk at startup), for the UK or North American English versions of the game. With a registry edit it can also be installed with the Australian English version (see Vista & Australian Version).

I tried this patch and got a message saying this is not the good game version.
Whats that mean?
Thanks

That means the patch did not find the expected localization information in the registry, either because it was not created, or because you have a different localization than the English UK / North American version.

Did you install the game from an account with administrative rights? Are you trying to play the game under the same account you installed it from?

There is a download and description of a reg file in this topic to add the required registry entries or simply change the language version to 'English' (which is what the patch is looking for). Alternately, you can email Larian's support to get a vbs file which will do the same thing in a much more user-friendly manner.
