1) I don't think so, that was changed because it was bugged and guards used to kill-steal. People complained.

3) Yes, you can see this when you hire new companions - they gain some XP to match you when you join, and I believe they also gain XP when in the hall of heroes (so you're not locked into only taking one party forever).
