Before the 1.31 hotfix they would disappear if you used the Lockpick skill, after that they are mostly unbreakable. If you got the lockpicks in a game started before installing the 1.33 patch, they will break if dropped on the ground. In v1.32 the game will use regular lockpicks first; I have not checked v1.33.
