Do you play solo? For pickpocketing I split the group, talk with the victim, change to the thief (it's Sebille, bad gal) and take the stuff. Then she runs like hell, I end the dialog, my group gets searched, all is fine. You can then even sell the stolen goods to the person it's stolen from.
Maybe they change it in the release but that's how I did it in the EA.
