this is an update.
I have solved two of my problems (read about them elsewhere on this forum) by installing the game on win me and installing patch v1.34 (where it works perfectly even with D3D on a radeon card. it ran the test without black screen frezze up. go figure.) i then installed the game on win xp drive (win me has it's own drive.)updated it with the same patch then copied from win me to win xp via a partition both can read then into the default install directory. they were both installed the same way, by the install discs and the defualt directory as i do for all games.
now i need help for the third problem only:

divinity error
unable to write to the installation directory
please make sure that there is still free space
on the drive wher Divinity is installed and that
you have the necessary access rights.
OK

i have tried removing the read-only attribute by right-clicking the game folder then selecting propteries and clicking the read-only box. this does not work as when i check it again a little green square is always there, (i do not have a checkmark in that little box always a little green square) also tried via the recovery console and command line with the same results.
the program is installed/played under computer administator on drive c on the primary ide channel. the drive has no errors.
i have directx 8.1b installed in both win xp and me.
i cannot go to directx 9.0 as i have a radeon ati 7500 card (please do not laugh)
i must tell you that the drive had to be reimaged before i installed the game the first time so could this be the problem. if it is how do i fix it without reformating or losing any info.
if no one can help me i can play the game in win me but i need to know the max size of the save games or if there is a way to tell one save from another so i can transfer it off the drive. i am asking this as the drive win me is on is only 8 gigs in size and has only 2.7 gigs of room left.
thanks for any help in advance.

What did you copie from me to Xp?? The save games?

Even on your me drive you have enough space for yor save games. IIRC the max size is around 60Mb/saved game.

i have a question for you. I dont know this, but what file system does me have? FAT or NTFS?

"divinity error
unable to write to the installation directory"

Did you try installing it under XP to the partition both ME and XP can access, if it is large enough? Maybe putting it on a FAT32 partition would help, if the problem is due to some conflict with NTFS' features.

"i have directx 8.1b installed in both win xp and me.

You shouldn't need DirectX 9.

"i must tell you that the drive had to be reimaged before i installed the game the first time so could this be the problem."

Possibly, but the game is not trying to do anything at a low level, so if other applications do not have a problem opening/changing/saving files on the partition, or in the Divinity folder (you could try saving a text file there...), I doubt this would do it.

"if no one can help me i can play the game in win me but i need to know the max size of the save games or if there is a way to tell one save from another so i can transfer it off the drive."

Saved games range from 20MB for a new game to about 70MB at the end. Each save is in a separate folder in the '..\Divine Divinity\Run\savegames' folder, and can individually (or as a group) be moved, deleted, backup or restored.

"and has only 2.7 gigs of room left."

That is lots of room. Old saves can also be zipped to compress them quite a bit, and/or moved to a different partition, etc.

thank you Raze and JolieKiller both the help. Win XP is NTFS and Win ME is fat 32. the partition that both can use is FAT 32. I will try to install it to the fat 32 partition and see if this helps. this partition is a go-between and a storage partition.
thanks again.
