You can talk to Trevor before or after Tingalf is arrested. I did so afterwards, and didn't have any problems with the quest. A couple people ran into this problem but didn't mind, since Tingalf stuck around to supply lockpicks and traps. In a game started after the 1.34 patch is installed Finnigan is also a good source for these.
