Larian rents their servers [as does Gog and Steam for that matter] which means you pick how much traffic you want to be able to handle... "the fix" is as easy as pay $ to cover more
yes forum traffic is a good idea of game download performance , during EA first release Gog slowed to a snail crawl and Steam crashed all together and that was only less then 10% of current costomers... add in press + spammers and Larian has two basic choices
