Is your save an autosave, quicksave or a hard save? Usually when I load a hard save, it puts me exactly where I was, so I have not experienced what you are describing.
Can you let us know which restricted area you are in:
There are restricted areas on the upper floors, on the same level and above Balthazar and Ketheric's Rooms
There's a restricted area in the basement Prison, center tower
There's a restricted area by the docks
Is your entire party in battle, or just one character? If you don't have a previous save and do not want to battle, look at the top of the aggroed guards, and check and see if it says "Temporarily Hostile." If it does, you always have the option to disengage, dash, and have your entire party flee. If that doesn't work, just let them take your character to jail (then try and break out).
