I don't have the option to get the lady incarcerated. I found the bloody dagger, the book and the poem. However I got the poem by destroying the chest. Or is this a bug?

I checked my journnal, I was never able to talk about the poem. The journal does acknowledge that I found the poem

I just tried it, and you should get the speech option "This love letter seems kind of incriminating..." when discussing her husband's murder, regardless of whether you open or destroy the chest. That should add a journal entry "Esmeralda denied that our letter proved her guilt."

Should the poem be in possession of the one doing the talking?

No, that shouldn't be necessary.

i have found quests which works like that. Pretty confusing. Later in game I have stored all books and papers in a bag of high charisma party speaker. Try it you ll never know.
