I have two scenarios I need feedback on --

A) I stole from merchant, I ran away, merchant searched my companion who has an item from a killed enemy/NPC (or a weapon/armor let's say Burro's club). Will my companion be challenged to a fight or demanded to go to jail?

B) A) I stole from merchant, I ran away, merchant searched my companion who has a stolen item from a merchant/NPC (or a weapon/armor). Will my companion be challenged to a fight or demanded to go to jail?

You only fight the merchant if you don't give the item back, fail a persuasion check, or don't bribe the NPC.

Thanks, going back to my original question, will the merchant be able to identify the stolen/transferred items even it if was owned by a different NPC (that I stole something that's not his/her property)?

I'm not sure, I had a stolen skillbook in my inventory for some time and no problems ever at searches. I don't know wether other items are treated differently. However, in the EA you could even sell the stolen stuff back to the victim of a theft, so maybe he also does not care for the goods from others.

I stole some items from a vendor, and left one of my party nearby so he would confront them. This had worked previously as I'd allow the search they wouldn't find the items I just stole and would wander off. I swear I'd done it 3 or 4 times then last night I did it and the vendor said something like "I didn't find what I was looking for, but evidence of another crime" and attacked me and wiped my party. *shrug*

I stood close to a companion; I had stolen items and the companion was being interrogated. When he accepted search, he gave up items that actually were in my inventory smile
